Open Adoption:
After the adoption takes place, the natural mother of the adopted child may wish to retain the right of visiting the child. In case the natural mother wishes to retain such right she can file a petition through an adoption law attorney in the adoption process and the court will allow her to retain such right.
Adoption by Estoppels:
If a married couple takes a child and acts as the parent of the child for many years without the formal adoption procedure, which creates an opinion and in the mind of the child and in the mind of the others that such child has been adopted by such parent or makes the child and others to believe that they are the natural parent, then the parent cannot deny that they have not adopted the child. This way of adoption is known as Adoption by estoppels.
Adoption by estoppels is a legal remedy given to the child to claim adoption. The situation may occur when the parent who takes care of the minor child dies without a Will. Then such a child can present a petition claiming all or any part of the estate.
Approach an adoption law attorney for filing a petition to claim property that you deserve to get. Even if there is a Will and the child’s name is not referred in the Will, still the child can claim for a portion of the property as an omitted child.
Both the natural parent and the adoptive parent can challenge an adoption on the grounds of fraud, coercion or undue influence if the adoption is obtained on those grounds.
Adoption by Step-Parent
If you are a bachelor or a widower, and if you marry after the adoption takes place, your spouse will become the step mother. The predeceased wife of the widower will not become the adoptive mother. If you are a spinster, your spouse will become the step father. The step parent as the case may be should obtain a formal adoption after giving due notice to the natural parents.
