Custodian Parent and Non-Custodian Parent:

If you obtain the sole physical custody of the child you become the custodian parent and the other spouse becomes the non custodian parent. Non custodian parent has the right for child visitation.

Parenting Plan

Parenting plan is the process of analyzing the issues of child custody, child visitation, child support, health, education, and welfare of the child by both the parents and they reach at a settlement so that the child is not disturbed of any complication of those issues which may arise in the future.

If the court decides about the child custody, then the court looks into the issues relating to child visitation and the payment of child support given by the non custodian parent. Before you file a petition at the court of law you can work out to prepare a parenting plan.

If you think that the process of the custody should go smoothly, you can work out with the other parent, relating to those issues by drafting an agreement and expressing your consent. If you present the parenting plan along with the petition for custody, the court shall pass orders based on the parenting plan.

Negligience of a Custodian Parent

The primary duty of a custodian parent is to take care of the child. If you do not take proper care of the child, and if it is brought to the knowledge of the court by the other side, the court shall order for the change of custody.

If you are a non custodian parent and if you see that your child is not taken proper care such as the education, health etc., you can approach the court asking your lawyer to represent your case by filing a petition to change the custody of such parent.
