Some general problems relating to Child Custody:

My child is in the custody of my ex wife and I am paying my child support, I see that my ex wife has become a full time drunkard. Can I obtain the custody of my child?

You can file a petition for the change of custody stating the fact, and you have to prove that your wife has become a full time drunkard. The Court after analyzing all the facts will change the custody to you.

My ex wife has got a job in a different state and has left my child in her sister’s house. How can I obtain the custody of my child?

The court will consider the reasons for leaving the child in her sister’s house, whether it is for temporary purpose due to various reasons like the study of the child. If she has left the child only for a permanent purpose you can obtain the custody. You can file a petition asking to exchange the custody, till your ex wife takes the child in her custody.

My child is in the custody of my husband. My husband has married now. Can I ask the court to change the custody?

Marriage does not break the custody from your husband unless it is proved that your child is not properly cared by your husband.

My husband who has the custody of my child is planning to settle in another state. How can I obtain the custody in this situation?

If your husband tries to go far away and settles in another state, you have the right to seek the court to change the custody by filing a petition. The court shall pass orders after going through the merits of the case, giving first preference to the best interest of the child and shall pass orders asking your husband to continue with the custody of the child or if the court thinks that it will not be in the interest of the child to continue such custody, shall order for an exchange of such custody to you.
