You can also ask the other spouse to provide for the support of health insurance if you depended on the other spouse income during your married life. Consult your attorney before filing the petition and he will assist you to claim support from the other spouse to be paid for health insurance.
If the medical insurance given to you is the employer sponsored group health insurance plan, under Federal law such group should offer continuation of the benefits at the group insurance rates for a period of three years after the termination of the marriage.
Divorce - Modification of Spousal Support Order
If you want to extend the period of spousal support payment from the other spouse, you have to file a petition to modify the order to extend the period of such support. You have to file the petition before the completion of the existing period of the spousal support order.
If the amount is not sufficient for you, you can file a petition requesting the court to modify the amount, explaining your situation, and the court may modify the order after considering the facts and circumstances.
If any special circumstances arise as to sudden medical treatment or any other situation which you need the support of the other spouse, you can file a petition seeking the court to modify the petition.
Divorce - Duration for spousal support
Paying spouse has to pay the spousal support till the other spouse earns for self supporting her needs and have to provide the support permanently:
- If the other spouse is of advanced age which becomes difficult to get an employment.
- If the other spouse suffers from any medical problem, due to which he/she cannot get an employment.
- If the marriage is of longer period, the court will consider the married life of the spouses, and may order to provide the spousal support permanently.
Under special circumstances if the paying spouse is unable to pay the spousal support ordered by the court due to the loss of his job or due to the decrease in his earnings he can file a petition requesting the court to decrease the spousal support amount or to stop payment of the spousal support for a temporary or permanent period as the case may be.
